Tenancy law
Whether residential or commercial premises, landlord or tenant: in tenancy law, considerable economic value meets a dense network of statutory requirements – particularly in Munich.
What matters
Residential property: strong tenant protection
Notice to quit by the landlord requires a legitimate interest. Rent increases are tied to the local comparative rent and the cap on rent increases.
Commercial leases: the contract decides
Commercial premises are largely subject to freedom of contract. This makes careful provisions on term, indexation, service charges and written form all the more important.
Service charge statements done correctly
Only agreed and recoverable costs may be charged. For residential property, the statement must be provided no later than twelve months after the end of the accounting period.
Notice to quit and eviction
Formal errors in notices to quit are common. We review notices carefully and support eviction proceedings through to enforcement.
